WAUWATOSA, Wis. (AP) -- A court says a suburban Milwaukee medical clinic is not exempt from property taxes.
The District 1 Court of Appeals on Tuesday ruled in favor of the city of Wauwatosa, which argued the St. Joseph Outpatient Center was a doctor's office and therefore has to pay taxes.
Covenant Healthcare System, Inc., originally owned the building, and then transferred it to St. Joseph Regional Medical Center, Inc., a related entity.
Covenant filed claims seeking refunds for its 2003, 2004, 2005 and 2006 taxes. It argues the building is exempted from them under a law designed to help nonprofit hospitals care for the sick.
The court overturned a judge's ruling and says the clinic is a doctor's office, which under state law cannot be tax-exempt.
