A former Rusk County Board member accused of illegally taking thousands of dollars from the county after the Ladysmith tornado will face charges again.
The Third District Court of Appeals has ordered felony counts of theft and misconduct in office to be reinstated for Bruce Halmstad, after a ruling on Tuesday a Circuit Court judge was wrong to dismis them.
Authorities say Halmstad received nearly five-thousand dollars from the county after claiming hundreds of hours of cleanup work from the Labor Day 2002 tornado.
Officials say he wasn't elgible for the money as a county board member. Halmstad got the charges dismissed by saying he was singled out for prosecution while two other supervisors in similar situations were not.
The Appeals court said on Tuesday that unlike Halmstad, the other two supervisors returned the money they received for cleanup.
