29-year old Ted Oswald had been convicted of robbing a bank, taking hostages, as well as nine counts of murder, which includes a conviction in the killing of a police captain in the City of Waukesha, but a federal judge overturned the convictions two years ago, paving the way for a retrial.

On Tuesday, a Waukesha County Judge reportedly dismissed Oswald's arguement that a retrial would violate his right to be proected against double jeopardy.

The jury is expected to be transported back to Waukesha County and sequestered, where the ensuing trial could last a month.
