A former West Salem elementary school principal, fired five weeks ago, says his dismissal was illegal and that he is suing the school district.
John Smalley says the district fired him because he was arrested for assaulting his wife. Smalley was terminated on January 25th.
He was charged with battery and disorderly conduct, for allegedly pushing his wife and pulling her hair during an argument. On Wednesday, Smalley pleaded guilty to disorderly conduct, and the battery charge was dismissed.
West Salem superintendent Nancy Burns has said Smalley was fired due to, quote, "neglect of duty and dishonesty surrounding job performance in recent months."
