Pepin County Woman Loses Appeal In Pregnancy Case

A state appeals court Tuesday rejected a woman's claim that her pregnancy forced her into a plea deal in a sexual assault case.

The court said 22-year-old Monika Lackershire of Pepin cannot withdraw her guilty plea after she said she feared the stress of a trial could have harmed her unborn baby.

Lackershire pleaded guilty in November, 2003 to having sex with a 14-year-old boy and was sentenced to three years in prison.

The Third District Court of Appeals in Wausau says Lackershire cannot withdraw her plea because she became pregnant during the sex acts, which were voluntary.

The three-judge panel says any coercion involving her plea was therefore self-imposed
