An Eau Claire City Council member charged with his third drunk driving offense and resisting arrest will spend close to two months in jail as part of his guilty plea this week in Chippewa County Court.
Toby Biegel was arrested in October for drinking and driving. his blood alcohol level was .24, three times the legal limit.
District Attorney Jon Theisen says as part of the plea, Biegel must enter an drunk driver intervention program and perform community service over the next four months.
Biegel's attorney says that Biegel regrets his actions the night of the arrest and takes responsibility for everything that happened.
After that time, Biegel will have to serve 55 days in jail, pay fines, and will have a 24 month suspension of his drivers license.
Biegel is scheduled to be sentenced in April.
