An appeals court ruled that a judge in Eau Claire County made a mistake in dismissing an officer's lawsuit against the subject of an underage drinking stop.
Tuesday morning, the 3rd District Court of Appeals said the judge in the case needs to hear more facts. It says nothing automatically blocks officers from bringing negligence claims when they're injured while on duty.
Michael Glennon, from the Eau Claire Police Department, sued 18-year-old Ross Hansen of Menomonie and his insurance company. Glennon hurt his knee when he tried to keep Hansen from running off during a college homecoming celebration in 2004. Judge Benjamin Proctor dismissed the suit. He ruled that it would open the door to claims that have no sensible or stopping point.
