UPDATE: 9/3/09
One man is in the hospital and two sheriff's deputies are on administrative leave after a shooting last night.
Eau Claire County Sheriff Ron Cramer says whenever deputies are involved in a shooting, as part of the department's standard procedure, they're put on leave.
The Eau Claire Police Department says 44-year old David J. Rubitski is in critical condition at Luther Hospital after deputies say he pointed a gun at them during a stand-off last night and was shot. People living in the area say they're just happy no one else was hurt.
"Pop, pop, pop, pop, and then there was a loud pop and that got us up and out of bed," says Peter Neuman.
Like many of his neighbors Peter Neuman woke up to the sound of gun fire.
"When we woke up at midnight there was I bet about 15 vehicles here, at least," says Neuman.
"To happen so close to home is kind of scary, yes it is," says Norma Dehnke.
Norma Dehnke owns the Watering Hole Bar which is across the street from where the stand off happened.
"I have been scared a few times since i owned this bar but now that i look back at it this is the worst," says Dehnke.
Eau Claire County Sheriff Ron Cramer says Rubitski's wife called the Eau Claire Dispatch Center around nine last night. She told them her husband was threatening her with a gun. Cramer says Rubitski left the home at 1345 County Road X with the gun and hid out in a van until deputies got there.
"They saw the individual moving around in the vehicle with a weapon, at some point in time two of our tactical people were able to extract the female from the trailer and get her out to my vehicle," says Sheriff Cramer.
He says after they rescued the woman, negotiators tried to convince Rubitski to give up but Cramer says he was combative and would not come out of the van and he finally pointed his rifle at deputies. Cramer says that's when two sheriff's deputies from the tactical team shot Rubitski in the abdomen.
"I certainly want to have clarity on this situation that we're not hiding anything that we did our jobs we did our jobs appropriately and I support what our officers had to do last night."
Cramer says the Eau Claire Police Department is heading up the investigation and the Eau Claire Police Department says right now it looks like the officers acted in self defense.
UPDATE FROM THE EAU CLAIRE POLICE DEPT.:
Several Eau Claire Police Officers worked all day meticulously documenting the scene, collecting evidence, and conducting thorough interviews. The preliminary information gathered at this point indicates that the officers involved acted appropriately in self defense and in the defense of the lives of other officers at the scene.
Investigators anticipate that more information will be available for release tomorrow. When the investigation is completed the reports will be forwarded to the District attorney for review. The suspect in this case is in critical condition at Luther Hospital.
