Eau Claire County District Attorney Rich White says deputies were justified when they shot a man after he pointed a weapon at them.
Investigators say on September 3rd, deputies were called to David J. Rubitski's home near Fall Creek after his wife said he was threatening her.
White says tried to negotiate with Rubitski while he barricaded himself in a van armed with several guns.
White says when Rubitski pointed a loaded rifle at the deputies, they fired fearing for their lives.
Rubitski was hit in the abdomen several times and then flown to the hospital.
White says the deputies actions protected law enforcement officers in the area. White says criminal charges against Rubitski are pending.
