Jeffrey A. Smith has agreed with the state that he is a sexually violent person and is now in custody of the Health and Family Services.

Smith served 16 years and 8 months for the rape and murder of Susan Fahrman. Both her family and DA Rich White felt that he should not be released into society and petitioned the court to keep Smith in custody. A trial in Hudson has been cancelled since Smith has agreed to further treatment.

He will spend an undetermined amount of time in Sand Ridge Secure Treatment Center, and won't be released until a judge or jury finds that he is no longer a threat to society.
