The Judge said the case against Bruce Halmsted was selective, vindictive and retaliatory. Halmsted was accused of illegally being reimbursed for cleanup work from the Ladysmith Tornado of 2002.
Prosecutors say Halmsted, as a County Board member, was not entitled to reimbursement. Judge Norman Yackel did, however, grant Halmsted's motion to dismiss saying he was entitled to an outside investigator.
Yackel did acknowledge tension between Halmstad, the Rusk County Sheriff and the District Attorney over whose budgets Halmstad has a degree of control over as a County Board member.
