An Eau Claire man who is already serving time in prison pleaded not guilty today to a disorderly conduct charge involving a hostile gesture made toward his wife. But, an Eau Claire county circuit court judge added 15 months to his existing prison term because of the gesture.

Paul Wiersgalla was originally charged with threatening a witness when he made a hostile gesture with his hands forming the likeness of a handgun. The incident took place earlier this year when he was leaving a courtroom after having been sentenced to five years in prison for attempting to hire someone to kill his wife.

The district attorney's office ammended the charge from threatening a witness to disorderly conduct after a search revealed that the offense did not fit within any particular statute other than disorderly conduct.
