McGlasson sentenced to 90 days jail, year probation
A former UW-Stout hockey player charged in the 2010 death of another student learned his fate Friday.

MENOMONIE, Wis. (WEAU) – It was a day of mixed emotions in court Friday, where a former UW-Stout hockey player learned his fate in the 2010 death of another student.

22-year-old Jedidiah McGlasson was sentenced to 90 days in jail in Dunn County and one year probation.

McGlasson pleaded guilty to disorderly conduct in November after being accused of pushing UW-Stout student Bradley Simon off a bike in September 2010, following a bar fight.

Bradley Simon’s parents spoke out at the proceeding Friday.

“We had no opportunity to help him heal from his brutal attack that ultimately took his life,” says the mother, Kathy Simon. “I feel that the criminal justice system has let our family down. I no longer have any faith in the saying that justice will prevail.”

Kathy Simon says she felt betrayed after the plea bargain that charged McGlasson with disorderly conduct.

“The reason for entering into this agreement had a lot to do with the fact that it'd be very difficult if not impossible for a jury to agree unanimously that Mr. McGlasson was guilty to felony murder, we certainly agreed it was disorderly and we reached this compromise,” says Dunn County district attorney Jim Peterson.

McGlasson’s attorney Eric Newmark says there’s no evidence that supports any notion that McGlasson killed Bradley Simon.

“He’s guilty of being drunk at a bar. The offense that occurred later, that's tragic but they're not my clients fault,” says Newmark.

Even McGlasson took a moment to speak out in front of his family, friends and the Simons.

“500 plus days, there hasn't been a day that’s gone by that I haven't thought about that night. I wish I wasn't there. I wish I was sitting at home or had gone somewhere else and I truly do feel sorry for you guys. I feel sorry you guys lost your son, it’s awful,” says McGlasson.

After much talk, Judge Rod Smeltzer gave the final verdict.

“Probation for a period of one year with held sentence 243 dollars in cost, and I’m going to order 90 days in jail,” says Smeltzer.

Smeltzer says if McGlasson completes 200 hours of community service and both families agree to restorative justice, then he’ll only have to serve 30 days in jail.

Kathy and Phillip Simon both say 90 days in jail is not a punishment that serves justice for their son’s death.

“We hope this will bring closure to this matter. I guess time will tell,” says Peterson.

“It was definitely a compromise. I guess the hallmark of a good compromise is that no one is happy,” says Newmark.

A civil case is still pending on the estate of Bradley Simon.

He was originally charged with felony aggravated battery and accessory to murder, but those charges were dropped.
