New details on why charges were dismissed against driver

EAU CLAIRE, Wis. (WEAU)-- We now know why charges were dismissed against a 91-year-old man who officers say hit and killed a bicyclist with his SUV last summer.

According to the Eau Claire County District Attorney's Office, Archie Van Wormer was found incompetent to stand trial.

Van Wormer lost his license after the crash last June and is at an extended care facility now with a deteriorated mental state.

Officers say Van Wormer drove onto a bikepath along Clairemont Avenue in Eau Claire, hitting and killing 51-year-old Kirk Cartwright.
