Wis. civil litigation provision angers attorney

MADISON, Wis. (AP) -- A Milwaukee attorney is angry over a provision adopted by the Legislature's budget committee that would further tighten Wisconsin's civil litigation rules.

Peter Earle represents 171 children who sued six white lead pigment manufactures whose products allegedly made them sick. The lawsuits -- filed between 2006 and 2011 and still pending in federal and state courts -- might all be nullified under the provision.

Gov. Scott Walker signed a law in February 2011 that made it harder to sue businesses by setting stricter standards for testimony and burdens of proof. It also put a cap on damages. The rules apply to lawsuits filed on or after the day that law became effective.

But the new provision would extend it to all cases currently pending.
