Randall Brion took his daughters swimming in the Chippewa River, where his five year old daugher descended to the bottom of the river where she rested unconscious.
A woman eventually revived the girl by performing C-P-R.
Witnessess say Brion was drinking beer and cleaning a marijuana pipe during the incident.
Brion has pleaded not guilty to all charges.
