Wisconsin's two Democratic senators voted against confirming Samuel Alito to the Supreme Court Tuesday.
The conservative judge took only four votes from Democrats in the Senate. Just one Republican voted against him in the 58-to-42 vote approving his nomination.
Senators Herb Kohl and Russ Feingold were among the "no" votes.
Chief Justice John Roberts is due to swear Alito in at the Supreme Court.
A ceremonial second swearing-in is scheduled at the White House East Room Wednesday.
