The truck driver charged with causing the deaths of five people associated with the Chippewa Falls High School band was in court for the first time Tuesday morning.
23-year-old Michael Kozlowski is making his initial appearance in Eau Claire County Circuit Court.
Kozlowski is charged with five counts of homicide by negligent operation of a vehicle, 11 counts of reckless driving that caused great bodily harm and nine counts of reckless driving that caused injury.
Eau Claire County District Attorney Rich White filed the charges after months of investigating.
In the criminal complaint against Kozlowski, witnesses say his movements on the road were unsteady.
It also says he was probably tired after being up all night the night before.
The National Transportation Safety Board report shows Kozlowski probably fell asleep behind the wheel.
He's out on a $50,000 signature bond. His next court appearance will be in late February.
