Chippewa Falls Man Loses Trial Appeal

Almost three years after a state appeals court granted a Chippewa Falls man a new trial, the same court Tuesday upheld his conviction on the same sexual assault charge.

The Wisconsin Third District Court of Appeals in Wausau rejected Larry Peterson's argument that a judge was wrong in refusing to allow a jury to hear some evidence related to the victim.

Nearly two years ago, the appeals court granted Peterson a new trial saying a Chippewa County jury failed to hear crucial evidence. That evidence involved whether Peterson was physically able to do what the victim claimed he did.

He was tried again, convicted and sentenced to seven years in prison. This time the appeals court upheld the conviction.
