A mistrial is declared Monday after a jury was unable to reach a decision in the case of former state worker Eugene Zapata.

68-year-old Zapata is charged with first- degree murder in the disappearance of his wife, Jeanette Zapata, more than 30years ago.

The couple was in the process of a messy divorce when she vanished from her home in Madison.

Prosecutors say Zapata killed his wife because he feared she would win full custody of their children and take the house they had shared.

A mistrial was declared after jurors said they could not reach a decision.
