Guilty verdict for man involved in fatal stabbing

HAYWARD, Wis. (WEAU) - A man charged in a deadly stabbing in Sawyer County has been found guilty of several charges, including Party to the crime of 1st Degree Reckless Homicide, and Party to the crime of Attempted Intentional Homicide.

In March, Marvin Corbine Jr. entered not guilty pleas to charges including First Degree Intentional Homicide as Party to a Crime. Police say in April of 2011, Corbine was involved in a fight at a home on the La Courte Oreilles Reservation.

John B. McDaniel, 23, died from multiple stab wounds.

Two other people were also stabbed and taken to the hospital.

Marvin Corbine Jr convicted of homicide by a Bayfield County Jury.

A 6 day jury trial concluded on Monday evening February 11th, 2013 with the reading of unanimous guilty verdicts. The Honorable Judge John Anderson presided over the case at the Bayfield County Courthouse in Washburn, WI. The case had been moved from Sawyer County to Bayfield County because of what was cited as pretrial publicity.

At the reading of the verdicts in front of Judge John Anderson, Marvin A Corbine Jr was found guilty of the following counts:

Count 1
Party to the crime of 1st degree Reckless Homicide of John McDaniel on April 22, 2011. A Class A felony

Count 2
Party to the crime of attempted Intentional Homicide of Derrick McDaniel on April 22, 2011. A Class A felony

Count 3
Party to the Crime of Aggravated Battery to Derrick McDaniel on April 22, 2011. A Class E Felony

Count 4
Party to the crime of Criminal Trespass a Dwelling which was the home of John and Derrick McDaniel on April 22, 2011. A class A misdemeanor

Count 5
Bail Jumping – Felony, A class H Felony.
Corbine was on a cash bond with no contact provisions for a pending burglary charge at the time the above listed crimes were committed.

The prosecution in the case was conducted by Assistant Sawyer County District Attorney Michael Mahoney. The prosecution presented more that 25 witnesses in their case and rested on Friday morning February 8th. The defense presented two witnesses including the defendant and rested on Monday morning February 11th. After jury instructions and closing arguments the jury deliberated for approximately 4 hours. The Jury returned unanimous guilty verdicts on all counts at approximately 8:00 p.m. Monday night. The trial was delayed Monday morning February 11th until 10:30 a.m. due to the snow storm that hit the region Sunday night.

After accepting the guilty verdicts, a presentence investigation was ordered by Judge Anderson. Corbine’s sentencing has been set for Wednesday May 8th at 09:00 a.m. at the Sawyer County courthouse by Judge Anderson.
