(WEAU) - One of the charges against a suspect accused of killing an Eau Claire man has been dismissed.
Online court records show a charge of battery or threat to a judge was thrown out for Larry Fernandez. As we first told you last month, Fernandez lashed out in court losing his temper in front of Judge Lisa Stark. According to the complaint while in jail, Fernandez talked about killing judge Stark, but Tuesday the court ruled that the statement wasn't a true threat.
Fernandez is accused of strangling Brian Harvey to death in Eau Claire last summer.
