The Outagamie County district attorney plans to appoint a special prosecutor to handle a possible battery case against Green Bay Packer linebacker Nick Barnett because her husband could be a potential witness.D.A. to name special prosecutor for possible Barnett case

District Attorney Carrie Schneider announced the development today.

Barnett was arrested early June 17th outside Wet, a downtown Appleton nightspot. Police say he allegedly pushed a female patron in the bar during an argument.

Barnett was booked into the Outagamie County Jail on a battery charge and released an hour later after posting 500 dollars cash bond.

Schneider says her husband, Kory, works for an area dealership that has sold cars to Barnett. He also played with Barnett in a June 18th charity softball game at Fox Cities Stadium. She says he overheard Barnett on the phone making a comment about what happened ... and that could be an issue.

She says she hopes to know by Monday who she will name as a special prosecutor.

Police turned their investigation over to Schneider Tuesday so that she could determine whether Barnett should be charged.
